Noncompete agreements seek to limit an employee from participating in specific types of activities after leaving a position with a company. The employee is restricted from performing these activities in a specific geographic area and during a period of time. These contracts help companies protect confidential information from competitors.

Florida's Noncompete Agreement Statute

While Florida is a right-to-work state, the legislature has enacted a law that permits noncompetition agreements, but draws the line about how far they can go. According to the statute, if the agreement falls within certain parameters of reasonableness, it is enforceable. If the agreement is overly broad, overlong, or otherwise not necessary to protect the employer's interests, the court will not enforce it.

A contract that prohibits a physician for one year from seeing former patients within five miles of the clinic where he was formerly employed would probably be considered enforceable. If the contract prevented the doctor from practicing anywhere in the state for 10 years, it would clearly be unenforceable. Most of the cases we litigate land in the gray area in between. It is the lawyer's job to determine whether your contract meets the criteria set forth in the statute and, if it does not, to persuade the court of why an exception is justified in your case.
